Abstract

Participation of the Sudanese in the Elections, and Political and Public Life from the Perspective of International Human Rights Law: Legal and Institutional Impediments Governing the Electoral Environment This article critically assesses the legal and institutional framework governing the participation of the Sudanese in the 2010 elections and their right to participate in the political and public life from the international human rights law perspective. It enquires whether this framework facilitated the free participation of all segments of the Sudanese society, in particular women and disabled persons and other vulnerable groups affected by the protracted armed conflicts in the country such as internally displaced persons and Sudanese refugees. The Article argues that the inaccessibility of the aforementioned groups to participate in the elections makes it incomplete and restrictive. This Article also argues that although Sudan has adopted and developed a new constitutional framework (the Interim National Constitution 2005) and enacted electoral laws (the National Elections Act 2008, and the Political Parties Act 2007), the scope of these laws is seriously limited by multiple legal and institutional impediments. In this respect, this Article highlights that the overall electoral environment is severely curtailed by inadequate legal and institutional framework which was in place well before the elections. Consequently, the 2010 elections, and of course, its associated processes cannot be described as conducted in a free environment or exercised in the context of a democratic society.
