Abstract

This study aims to explore the Islamic jurisprudential rulings regarding the use of illicit funds in charitable
activities, through a comparative fiqh approach utilizing multiple research methods such as jurisprudential
comparison, analysis, and deduction. The study reviews and analyzes the opinions of Islamic jurists and schools
of thought, discusses the legal evidences upon which these opinions are based, and identifies the prevailing
opinion in accordance with Shariah principles and objectives. Moreover, the study addresses the reality of illicit
funds, their negative impact on society, and clarifies the positions of Islamic charitable institutions regarding
the acceptance of donations from non-Islamic entities. The study concludes that it is permissible to channel
illicitly acquired funds towards charitable and public-benefit activities, provided that the person who originally
obtained or participated in obtaining these funds does not benefit in any way from them. Additionally, adherence
to Shariah guidelines is required to prevent encouraging or perpetuating unlawful earnings. The study
recommends raising community awareness about the significance of lawful earnings and the dangers associated
with illicit funds, encouraging charitable institutions to establish clear criteria for accepting donations from
non-Islamic entities, and verifying the legitimacy of such funds and the nature of donor entities. Furthermore,
the study emphasizes the importance of enhancing disciplined cooperation between Islamic charitable
organizations and other non-Islamic entities, in ways consistent with the objectives of Shariah and serving the
general interests of Muslims.
